The Ministry is responsible for monitoring the implementation of the Code of Practice for Health Workers, and the Infant Nutrition Council Code of Practice for the Marketing of Infant Formula.

Its Compliance Panel is responsible for making decisions on complaints referred to it relating to a breach of either of these Codes.

The Compliance Panel typically meets between two and four times a year, depending on the number of complaints received (via face-to-face meetings and videoconference).

The Chair spends up to 50 hours per annum on Compliance Panel work.

The Chair should :

  • Have a strong procedural background, with a background in law desirable
  • Understand legal procedures and principles, particularly knowledge of procedural fairness based on the principles of nature justice
  • Be experienced in meeting procedure and understand due process
  • Have strong leadership skills
  • Have an understanding of regulatory and self-regulatory processes
  • Be aware of the WHO International Code of Marketing of Breast-milk Substitutes (1981) and the Code in New Zealand
  • Be able to engage with colleagues for shared decision making and exercise analytical and judgement skills, specifically when to seek external cultural or technical expertise
  • Have an awareness of He Korowai Oranga and Whānau Ora, and
  • Demonstrate links to Māori and Pacific communities and / or to the disability sector (desirable).
