What you will learn and contribute to

As part of our team, you will :

  • Bring expert knowledge and CM discipline to pre-sales and post sales teams Project Management, Account Management , Bid Management, and Finance.
  • Review terms & conditions of contracts and change orders to assess & manage risk, and improve competitive position.
  • Ensure terms support required cashflow and revenue recognition requirements.
  • Calculation of financial provisions in conjunction with Finance.
  • Establish claims discipline and LD avoidance strategies.
  • Maintenance of "fit for purpose" records, reporting and communications.
  • Pre-Sales & Contract Development

  • Assist legal, commercial and procurement managers in development of new contracts & agreements, Performance & Warranty Bonds and Bank Guarantees.
  • Work with procurement to pre-qualify a supplier's contractual terms and conditions for best fit with any particular contract to minimize the life cycle risks.
  • Validate warranty, support and all necessary services are aligned with main contract, and that the complete range of services required during the project life cycle are included in a priced vendors submission;
  • to include manuals, extended warranty, repair and return, spares availability in years, hot-line support, in-country support, bugs and fixes, upgrades, Escrow, PI insurance.

  • Create invoicing plan and work with Finance to confirm revenue recognition.
  • Ensure positive cash flow considering customer payment inflows and third-party outflows.
  • Secure payment guarantees from customer.
  • Secure performance guarantees as necessary from suppliers / sub cons.
  • Work with Procurement to ensure obligations are back-to-backed with suppliers.
  • General Contract Management

  • Control the contract ensuring technical and commercial aspects are fully aligned for contract closing on time with full payments, to include claims and variations.
  • Contractual interpretation and advice to all project team members.
  • Damages avoidance plan, and credit-back strategy.
  • Liaison with Legal for resolution of contractual queries and issues.
  • List and communicate for delivery of miscellaneous contract deliverables.
  • Change Order and Claim Management

  • Ensure a formal record keeping & correspondence tracking is in place.
  • Ensure records and communications to support any future claims negotiations for extra work done, delays, suspensions, force majeure etc.
  • Take ownership for GPM of contract extensions, Variations, renewals, potential disputes, and penalties. Draft contract documents as required.
  • Define Change Order or Claim scope and associated contractual requirements.
  • Ensure timely document submission + clarification, negotiation & client sign-off.
  • Client Liaison and Official Correspondence.
  • Working with the GPM, establish formal meetings with Client and Sub-cons / suppliers.
  • Issues follow-up & closure with project team.
  • Project closing preparation, negotiation, and contract close-out.
  • Acceptance, Payment and Financial

  • Ensure acceptance certificates are agreed for triggering invoicing.
  • Agree pro rata payment procedure with Client to minimize cash flow issues.
  • Mange Finance Guarantees and Bonds, Insurances.
  • Monitoring and extensions of Bonds with the Finance Dept. as required.
  • Retention monitoring with Finance.
  • Ensure contractual insurance and indemnity requirements are fulfilled, to include Professional Indemnity insurance (errors and omissions) from sub-system suppliers.
  • Assist GPM, Finance and others in the preparation of project performance reports, presentations and analysis.
  • Your skills and experience

    You will have :

  • Knowledge of or experience with defining / negotiating major / strategic contracts recognized as "best in class" or experience with "improving underperforming deals" for Service Providers.
  • Specifically, expertise in scope management and KPI / SLA risk mitigation is desired.

  • 5-10 years contract management or program scope management / control experience in complex multi-technology / service contracts
  • Proven capability for commercially effective contract outcomes
  • In depth understanding of negotiation & program management processes
  • Strong business and negotiations acumen in international environment
  • Ability / experience communicating complex commercial issues at senior levels
  • Demonstrate a consistent understanding of how the organization delivers programs to commitment and to project cost.
  • It would be nice if you also had :
